Self-Audit Programs

The U.S. Department of Labor is committed to providing smooth paths to compliance with the laws we enforce. Our compliance assistance resources and self-audit programs aim to help employers, unions and employee benefit plan officials proactively review and correct potential violations – without formal investigations or litigation. Select a topic below to learn more about our self-audit programs.

Wage and Leave Issues

Employers can independently identify and resolve minimum wage, overtime, and leave violations under the Fair Labor Standards Act and Family and Medical Leave Act through the Payroll Audit Independent Determination program.

Workplace Safety And Health

Small-and medium-sized businesses can arrange no-cost, confidential safety and health evaluations through the Occupational Safety and Health Administration's On-Site Consultation Program. OSHA also recognizes employers with strong safety and health programs and low injury and illness rates through its Voluntary Protection Programs.

Employee Benefit Plan Issues

The Employee Benefits Security Administration's correction programs make it easy for you to comply with the law and fix violations. Employee benefit plan officials who discover fiduciary violations and prohibited transactions such as delinquent contributions and improper plan expenses while auditing their programs can correct them through the Voluntary Fiduciary Correction Program. The Delinquent Filer Voluntary Compliance Program encourages timely reporting of Form 5500, offering reduced penalties for self-identified late filers.

Mine Safety and Health

MSHA's new Compliance Assistance in Safety and Health (CASH) program features resources available to mining operations via an information hub on the MSHA.gov website. This hub provides links to a variety of safety and health topics to assist mining operations and provides direct contact to safety and health specialists to address your needs related to compliance assistance. Additionally, new mine operators can access an array of valuable safety and health information designed to ease the complexity of opening a new mining operation.

Veteran and Service Member Employment

Employers can use compliance assistance resources, accompanied by convenient and responsive technical assistance, to proactively review their policies and practices and ensure they're complying with the Uniformed Services Employment and Reemployment Rights Act (USERRA). SALUTE: Support and Assistance for Leaders in USERRA Training and Employment fosters good-faith compliance and helps ensure service members' employment rights are respected.

Strengthening Union Processes

The Office of Labor-Management Standards administers the Voluntary Compliance Partnership program to assist unions and their affiliates in assessing their compliance with the Labor-Management Reporting and Disclosure Act. The program focuses on key areas such as reporting and disclosure requirements, as well as financial integrity. Through the program, the labor union partners review reporting practices, identify potential compliance issues, and work to strengthen alignment with the act's standards.
