Our Mission
The Administrative Review Board (ARB) reviews appeals in cases involving, but not limited to, worker protections, whistleblower laws, immigration programs, child labor, job training, and federal contracts. Most cases come from decisions made by Department of Labor judges or the Wage and Hour Division. The mission is to ensure fair and timely decisions that are legally sound and treat all parties with impartiality.

The Administrative Review Board issues final agency decisions for the Secretary of Labor under Secretary’s Order No. 01-2020 (Delegation of Authority and Assignment of Responsibility to the Administrative Review Board (Secretary’s discretionary review of ARB decisions)), 85 Fed. Reg. 13186 (Mar. 6, 2020).
Yes, the Administrative Review Board Rules of Practice and Procedure are found at 29 C.F.R. Part 26. The implementing regulations for the statute under which the complaint is filed may also include regulations that govern an appeal to the Administrative Review Board.
Self-represented (pro se) litigants may choose to file an appeal, pleading, or other document with the Board in paper form by regular mail at U.S. Department of Labor, Administrative Review Board, ATTN: Office of the Clerk of the Appellate Boards (OCAB), 200 Constitution Ave. NW, Washington, DC 20210, or by fax at (202) 693-6220. Otherwise, parties represented by counsel must use the Board’s eFile/eServe system to file motions and briefs, absent good cause shown.
